Top court: childbirth choice not absolute, must not endanger child
The Supreme Court of the Czech Republic has ruled that a mother’s freedom to choose the place and method of childbirth is not absolute, stressing it ends where the duty to protect a child’s life and health begins. The court rejected an appeal by a woman—herself a midwife—who opted for a high-risk home birth despite medical warnings. The child suffered severe brain damage and died weeks later. Lower courts had given her a suspended ten-month prison sentence, which the Supreme Court upheld. The ruling confirms that parental choice is limited in cases where serious medical risks are clearly known in advance.
