Supreme Administrative Court annulled measure prohibiting signing of the Dukovany contract

The Supreme Administrative Court (NSS) has overturned, based on cassation complaints filed by the companies Elektrárna Dukovany II (EDU II) and KHNP, a preliminary injunction that prohibited the signing of a contract for the construction of new units at the Dukovany nuclear power plant. The case is being sent back to the Regional Court in Brno. The NSS announced this in a press release published on its website; the full judgment is also available on the court’s official notice board. There are now no legal obstacles to signing the contract, as the lawsuit at the regional court does not have a suspensive effect. The Regional Court in Brno will no longer consider issuing a preliminary injunction again.
